Welcome to Kewrate. By accessing or using our social shopping platform ('Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Kewrate. We may update these Terms from time to time, and your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

You must be at least 13 years old to use Kewrate. If you are under 18, you must have permission from a parent or legal guardian to use the Service.

By using Kewrate, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.

To use certain features of Kewrate, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not use another person's account without permission, and you may not create an account using false or misleading information.

You agree to use Kewrate only for lawful purposes and in accordance with these Terms. You agree NOT to:

Kewrate allows you to create and share content, including wishlists, profile information, and messages ('User Content'). You retain ownership of your User Content, but you grant Kewrate a license to use, display, and distribute your User Content as necessary to provide the Service.

You are solely responsible for your User Content and the consequences of posting or sharing it. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any applicable laws.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

Kewrate provides tools for creating wishlists and claiming gifts. When you claim a gift on someone's wishlist, you are indicating your intention to purchase that gift. Claims are not legally binding contracts, but we expect users to honor their claims in good faith.

You understand that Kewrate does not facilitate actual purchases or payments between users. We simply provide coordination tools. All purchases are made directly with retailers, and Kewrate is not responsible for the fulfillment, quality, or delivery of gifts.

You may unclaim a gift if your circumstances change, but we encourage you to do so promptly to allow others to claim it.

Kewrate allows users to coordinate group gifts by pooling contributions. When you participate in a group gift, you agree to contribute the amount you commit to.

Kewrate does not process payments or hold funds for group gifts. Users are responsible for arranging payment among themselves. We provide coordination tools only.

We are not responsible for disputes arising from group gift arrangements, including non-payment by participants or disagreements about gift selection.

Kewrate participates in affiliate marketing programs with various retailers, including Amazon Associates, ShareASale, and CJ Affiliate. When you click on product links in wishlists and make purchases, we may earn a commission from the retailer at no additional cost to you.

These affiliate commissions help us keep Kewrate free for users and support ongoing development and improvement of the platform.

We do not allow affiliate relationships to influence which products are displayed or recommended. Product links in wishlists are added by users, not by Kewrate.

By using Kewrate, you acknowledge and agree that we may earn commissions from your purchases through affiliate links. For more information, please see our Affiliate Disclosure page.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Kewrate, you agree to our Privacy Policy.

You control who can see your wishlists and personal information through privacy settings. However, information you choose to share with friends and family will be visible to them.

Kewrate and its content, features, and functionality are owned by Kewrate and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission. You may not reverse engineer or attempt to extract source code from our Service.

The Kewrate name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Kewrate. You may not use these marks without our prior written permission.

Kewrate may contain links to third-party websites, including retailer websites where wishlist items can be purchased. These links are provided for your convenience, and we do not endorse or assume responsibility for the content, products, or services of third-party sites.

Your interactions with third-party websites are governed by their terms of service and privacy policies. We encourage you to review these policies before making purchases or providing personal information.

We are not responsible for any damages or losses resulting from your use of third-party websites or services.

Kewrate is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

We are not responsible for the accuracy, completeness, or reliability of User Content, including wishlist items, prices, or product information. Users are responsible for verifying information before making purchases.

To the fullest extent permitted by law, Kewrate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability to you for any claims arising from your use of Kewrate shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Kewrate, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from:

1. Your use of the Service or violation of these Terms

2. Your User Content or any content you post or share

You agree to waive any right to a jury trial and to participate in class action lawsuits against Kewrate.

Entire Agreement: These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and Kewrate regarding the Service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
